The Broadhurst Magistrate Court has ordered the State to return money it seized from three men accused of car theft, ruling that it was deposited into government coffers without court approval.
Tirayaone Masisi, Gonyadiwang Masisi, and David Molefe were arrested on June 2024 for allegedly stealing a grey Mazda Demio worth P17,000 in Mmopane. Following their arrest, police confiscated various items, including cash. While other property was returned, the money remained withheld.
Magistrate Tshepo Mathale ruled that the funds must be returned within 14 days, granting the State the same period to lodge an appeal.
Meanwhile, bail was denied for Gonyadiwang Masisi and David Molefe, who may appeal at the High Court. Tirayaone Masisi remains out on bail and the case will return to court for final case management on June 15
